Privacy Policy
Vyopta Incorporated (Vyopta) recognizes the importance of protecting the privacy of information that we may collect from you.  We have developed a Privacy Policy that covers how we collect, store, use or disclose your information.

Collection and Use of Information

Vyopta collects two basic types of information –personal or anonymous information –and we may use a combination of this information. We collect the following categories of information:

  • Contact Information: This is contact information that is collected when you request information about our services; request customer support; use our “Contact Us” or similar features; register to use our sites or third-party sites, sign up for an event, webinar or contest; or download certain content, such as whitepapers from our sites or third-party sites. We may collect information such as your name, title, company name, address, phone number, email address, IP addresses or a username and password.
  • Financial or Billing Information: If you make a purchase through our site or register for an event or webinar, we may collect financial and billing information, such as billing name, address, credit card number or bank account information.
  • Event Visitor Information: If you attend one of our events, we may collect from you information such as name, title, address, geographical location, phone number, IP addresses and email address, which may be used to contact you.
  • Community Profile Information: We may also collect from you information that you provide for any public forum or online community that we host, such as a username, photo and/or biographical information (occupation, social media profiles, profiles on other forums, company name and areas of expertise).
  • Office Visitor Information: If you visit our offices, we may require that you register as a visitor, and we may collect your name, address, email address, phone number, photo, company name and date and time of your visit.
  • Pictures, Videos or Audio Recordings: This information may be collected in a variety of contexts, such as during participation in an event.
  • Processed Information: We may also collect information that is collected by your organization and provided to us for processing, which may include name, title, email address, phone number, video contact information, and IP addresses.
  • Device and Geographic Information: By using our sites, we may collect from your devices technical information such as your IP address, device type, unique device identifiers, browser-type, broad geographic location, user-ID, and other technical data.  Additional information that may be collected include your interaction with our sites, such as pages that are accessed and viewed.

How we use your personal information

If you do provide us with personal information:

  • The personal information Vyopta collects allows us to keep you informed about our latest product announcements, software updates, and events. We also use this information to improve our services, content, and marketing efforts. If you don’t want to be on our mailing list, you can opt out anytime by contacting us ([email protected]).
  • From time to time, we may use your personal information to send important notices, such as communications about to our terms, conditions, and policies. These notices are important to your interaction with Vyopta, and you may not opt out of receiving these communications.
  • We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.
  • Information may be used to carry out our contractual obligations, which could include reporting, monitoring and analytics for your organization’s unified collaboration and communications environment to help with strategic initiatives, quality control and troubleshooting.
  • We may use, with your prior consent, customer testimonials or comments.
  • We also use information to comply with applicable laws and regulations.

How we use your anonymous information

We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information such as occupation, language, zip code, area code, location, device id, and the time zone where our website, portal or applications are used so that we can better understand customer behavior and improve our products, services, and advertising.
  • We also may collect information regarding customer activities on our website, portal, software-as-a-service, and from our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, portal, products, and services are of most interest. Aggregated data is considered non-personal information for the purposes of this Privacy Policy.
  • Aggregated data may also be used to help us further develop our product and for benchmarking purposes for us to provide comparative analytics to our customers.

If we do combine anonymous information with personal information the combined information will be treated as personal information for as long as it remains combined.

How we may share your personal information
We may disclose your personal data to the following categories of recipients for our business purposes:

  • to third-party service providers that support our business and operations;
  • to law enforcement, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
  • to a Vyopta partner if you have provided us your contact information, so that you may be contacted by a designated Vyopta partner for Vyopta’s commercial purposes;
  • to an actual or potential acquirer (and its agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided however that we will inform the buyer that it must use your personal information only for the purposes disclosed in this Privacy Policy; and
  • to any other person with your consent to the disclosure or as allowed by applicable data protection law.

Additionally, Vyotpa may share contact information that we collect directly from you or during some of Vyopta’s events, such as Vyopta’s seminars with sponsors and hosts of such events, for valuable consideration from such sponsor or host to Vyopta. Such sponsor or host may use it for their business or commercial purposes.

Except as otherwise stated in this Privacy Policy, we do not and will not sell personal information.

Cookies and Other Technologies
Vyopta’s website, online services, and applications may use “cookies” or other technologies.  These technologies help us better understand user behavior, which parts of our websites users visit, and aid us in determining the effectiveness of our marketing efforts and web searches.  We treat the information collected by cookies and other technologies as anonymous information. However, to the extent that IP addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy. We may also link information stored on your computer in cookies with personal data about specific individuals stored on our servers.

Like most websites, we gather some information automatically and store it in log files. This information includes IP addresses, browser type and language, Internet service provider (ISP), referring and exit pages, operating system, date/time stamp, and clickstream data. We use this information for trend analysis, site administration, understanding user behavior on the site, and gathering information about our user base as a whole. If you set up your web browser (for example, Internet Explorer, Chrome or Firefox) so that cookies are not allowed, you might not be able to use some or all of the features of our website.

In some of our email messages, we use a “click-through URL” linked to content on our website. When users click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.

Third Parties and Services
We may receive personal information about you from other sources (i.e. contact information) from other companies that provide our services by way of a co-branded or private-labelled websites, or companies that provide services in connection with ours (resellers or channel partners).  These organizations may provide us your name and other contact information to help us establish the account and fulfill orders.

At times Vyopta may make certain personal information available to strategic partners that work with Vyopta to provide products and services, or that help Vyopta market to customers. Personal information will only be shared by Vyopta to provide or improve our products, services and advertising; it will not be shared with third parties for their marketing purposes.

Your Organization and Its Third-Parties

Vyopta may provide our customers with the ability, at their discretion, to integrate our services with a third-party service (such as, your internal support ticketing systems, CRMs or other such business systems).  When integrated, we may share information with your organization’s third party provider.  We are not responsible for how the third-party integrator may collect, use and share your information.  Information that we may collect from third parties include address, titles, email addresses, phone numbers, IP addresses and social media profiles.

Service Providers, Resellers/Channel Partners and Technical Providers

Vyopta may collect from and share personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever Vyopta operates.  Information that we may collect for these parties include address, titles, email addresses, phone numbers and details of potential customer’s collaboration environment (for tailoring our services).

Others

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Vyopta to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

Vyopta websites, products, applications, and services may contain links to third-party websites, products, and services.  We do not control or have responsibility for the content or practices of these third-party sites.  Our provisioning of these links is not an endorsement of those websites, content, owners or practices.  Our Privacy Policy does not extend to these other websites, which are governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

Protection of Personal Information
Vyopta takes precautions to protect your personal information against loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

Vyopta’s online services use Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected. Doing so protects the confidentiality of your personal information while it’s transmitted over the Internet. Please be aware though that, despite our best efforts, no security measures are perfect or impenetrable.

When you use some Vyopta products, services, or applications or post on a Vyopta forum, chat room, or social networking service, the personal information you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to submit in these instances. Please take care when using these features. Additionally, to assist with protecting your privacy, be sure to never share your account login information with anyone else, log off of the Vyopta website, portal or applications when you are finished and take customary precautions to guard against “malware.”

Some of our applications may run on virtualized servers hosted by third-party hosting vendors with whom we have contracted. While we host with these third-party vendors and they control and operate the physical server environment, we do not provide them with access to your personal information.  We endeavor to use hosting vendors with privacy protection policies and procedures as strict if not more protective than ours.

Integrity and Retention of Personal Information
Vyopta makes it easy for you to keep your personal information accurate, complete, and up to date. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy and this period will vary depending on your interactions with us (for instance, where you have made a purchase with us, we may keep a record to ensure the adequate provision of services to you).  We may also keep records for a longer retention period as may be required or permitted by law.  In determining the appropriate retention period, we will take into consideration the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the personal information and whether we can achieve those goals through other means, and the applicable legal requirements.

Access to Personal Information
You have the following data protection rights:

  • Request to know if and how we use. Your personal information and to access, correct, update or delete your personal information
  • Object to the processing of your personal information when that processing is based upon our legitimate business interests, including a request for us to restrict processing of your personal information or request portability of your personal information
  • Withdraw your consent, if previously provided, for us to process your personal information; provided that, this withdrawal will not affect or invalidate the lawfulness of any processing performed by us prior to the withdrawal of your consent, nor will it affect processing of your personal information made in reliance of lawful processing grounds other than your consent
  • Request to modify, or remove any content that you may have posted to our website, blog or forum
  • Request to opt out of or limit the amount of personal information that we use or pass on to third-parties.
  • Request to opt out of promotional email communications by clicking on unsubscribe links or submitting a request to us ([email protected])
  • Complain to a data protection authority about our collection and use of your personal information (for more information contact your local data protection authority).
  • Deactivate your account

For other personal information, we make good faith efforts to provide you with access so you can request that we correct the data if it is inaccurate or delete the data if Vyopta is not required to retain it by law or for legitimate business purposes. We may decline requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law.

Children
You must be at least 16 years old to use Vyopta’s website, portal, products or services. We do not knowingly collect personal information from children under 16. If we learn that we have collected the personal information of anyone under the age of 16 we will take steps to delete the information as soon as possible.

Public Forums/Social Media
We may offer publicly accessible message boards, blogs and community forums.  We encourage you to bear in mind that if you disclose information on any of these mediums, the information you provide may be collected and used by others.  We will correct or delete any information that you may have provided at your request.

For EU Individuals: Your Rights Under GDPR
If you provide information to us, your personal information may be transferred to and processed in a country other than the country in which you are located.  These countries may have data protection laws that are different from your country.  Vyopta’s operations are located primarily in the United States and your data may be transferred and processed in the United States.  Specifically, if you are in the EEA or the United Kingdom, you should be aware and understand that your personal information will be accessed by Vyopta staff or suppliers, transferred, and/or stored outside the EEA and the United Kingdom, including the United States and other countries with have different data protection laws.  Please note that Vyopta has taken appropriate safeguards and actions to require that your personal information be protected according to this Privacy Policy and as required by applicable law, including, but not limited to, requiring that any third-party service providers or partners that may have access to your personal information employ adequate methods of transfer, such as the EC’s Standard Contractual Clauses.

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you.

If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time what those legitimate interests are.

California Privacy Rights
Under the California Consumer Privacy Act, if you are a California resident have the following data protection rights:

  • you can request that we disclose to you what personal information we collect, disclose for a business purpose and/or sell about you
  • you have the right to request the removal or deletion of personal information that we collect from you
  • you can request certain information about the types of personal information (if any) shared by us with third-parties (if any) for direct marketing purposes within the preceding calendar year, along with the names and addresses of these third parties. You may make one (1) request per calendar year, and we will respond to the request within thirty (30) days.
  • you have the right to opt-out of the sale of your personal information
  • you have the right to not be discriminated against based on your exercise of data protection rights, and we will not discriminate against any person for doing so
  • Please also be aware that California’s “Shine the Light” law only applies to certain types of personal information and only those types of personal information covered by the law will be included in our response.

We will respond to all these requests promptly and in accordance with applicable data protection laws.  If clarification is required, we may ask that you provide additional information so that we may accurately respond to your request or verify that you are making the request with respect to your own personal information.

Changes to this privacy policy
Vyopta reserve the right to change this Privacy Policy as we deem necessary or appropriate because of legal compliance requirements or changes in our business practices. When we change the policy in a material way, a notice will be posted on our website along with the updated Privacy Policy.
